The Split Estate Issue
Wyoming and Montana, like other Western states, recognize separate ownership of the surface estate and subsurface estate (where the minerals lie) and the distinct property rights associated with each. Often, different parties own the surface and subsurface. This is commonly referred to as “split estate” lands.

Surface Owner Agreements
Surface owner agreements are negotiated between the surface owner and the mineral lessee and describe how the mineral lessee will enter upon the surface, develop and extract the natural gas. Even if the surface owner does not own minerals, an agreement is still negotiated. LEARN MORE

Royalty Owner Information
Royalty owners are those who own the mineral rights or subsurface on the property to be developed. For those who are inexperienced in negotiating an acceptable oil and gas lease, we recommend Hints on Negotiating an Oil and Gas Lease from the Real Estate Center.

Water Management Options
The water produced by CBNG development will be sent to agreed-upon management sites on the property. These must conform to regulatory guidelines. Most water may be discharged into drainages including off-channel reservoirs, in-channel ponds and stock tanks.
